FAQs
We own our home together but are not married. Do we both need a will?
Yes. How your home passes depends on how you own it. As joint tenants, your share goes to your partner automatically. As tenants in common, it does not, and without a will it could go to your children or other relatives instead. Everything else you own follows the intestacy rules, which give an unmarried partner no automatic right to inherit. A pair of wills protects you both.
Can I choose who looks after my children in my will?
Yes. You can name a guardian for any child under 18, and for many parents it is the main reason to make a will. If both parents die without naming one, a court may have to decide. It is also wise to name a back-up, in case your first choice cannot take on the role.
Can a friend or family member witness my will?
A will needs two witnesses, both present when you sign. Anyone you leave a gift to should not witness it, and neither should their husband, wife or civil partner, or their gift could fail. A neighbour or work colleague is usually a safe choice. When we oversee will writing in Cardiff homes, we check that the witnessing is right before we leave.
How often should I review or update my will once it's written?
As a general rule, review your will every three to five years, or straight away after a major life event such as marriage, divorce, a new child or grandchild, or a significant change in what you own. Circumstances change quietly over time, and a will that isn't kept current can end up out of step with what you'd actually want.
